There is a difference in "cold air" and open air. Cold air will usually put the filter down low and near the wheel well. Always a chance of hydro lock in heavy rain. But an open element just allows more filtered air into the engine. Factory intakes have to take in account for noise. Open element air intakes are free to abuse the dbs.
